General conditions of sale - GCS

The present general conditions of sale apply in an exclusive way between company ISOLDE s.à.r.l. (hereafter “Salesman”) and any person visiting or carrying out a purchase via our site “Online-Shop” (hereafter “Purchasing”). Any person can take note of the general conditions of sale on our site. These general conditions of sale being able to be the subject of modifications, the applicable conditions are those in force on the Site at the date of making of your order.

1 Conditions of sale

You declare be old at least 18 years and to have the legal capacity or to be titular of a parental authorization allowing You to carry out an order on the Site. By ordering your articles via Internet or e-mail the Purchaser accepts our GCS and of delivery and concluded a contract with the Salesman. After having placed your order, email is addressed to you, confirming this one. You have nevertheless the possibility of modifying your order until the dispatch date of your articles. The prices posted on the Site are indicated in euros all Luxembourg taxes included/understood (applicable VAT, and other taxes), except share in the expenses of port, insurance and at the expenses of treatment of your order. It may be that a restricted number among the articles being reproduced on our Site comprises an error of price. We carry out the checking of the prices at the time of the procedure of sending of your article. If the Purchaser would be late in the payment of the price, we would have the right to claim post maturity interest calculated on the basis of statutory rate into force and applicable as from the day of the summation to pay.

2 Reserve of property

The delivered goods will remain our property until their forwarding during the handing-over to the conveyor, once you discharged the price from them.

3 Guarantees

3.1 You profit from the provisions of the legal guarantee. Generally the guarantee is 12 months.

3.2 We commit ourselves taking all the care of use in the profession for the implementation of the service offered to the customer. Nevertheless, our responsibility could not be retained in the event of failure with our contractual obligations because of a fortuitous occurence or of a case of absolute necessity as defined by the jurisprudence returned by the Luxembourg jurisdictions. In the event of nonsubstantial differences between the photographs of presentation of the articles on our Site, texts and illustrations and the articles ordered, our responsibility will not be committed. To in no case we will not incur a responsibility for losses of benefit, losses commercial, losses of data or loss of earnings or any other consequential damage or which were not foreseeable at the moment of the use of the Site or the conclusion of the sale contract between the Salesman and the Purchaser.

3.3 No guarantee without invoice.

4 Right of cancellation and return

You have the right of cancellation during seven (7) days, as expected by law. You may revoke your order without giving any reasons and this by writing us. The period begins earliest with receiving the goods. 
Returns are accepted only in undamaged condition. The revocation is excluded especially for books, newspapers, leaflets, brochures. In the event of revocation the goods have to be returned in their original packaging to the Isolde GmbH (Nostalgie). In any case, the customer has to support the “return” shipping costs. At receipt of the returned items the price we will be paid back, after deduction of eventual costs that we really will have. You know, if you send a package without insurance, you will be responsible for possible damage. 
Upon delivery of an item during the shipment was damaged, let us directly know when you receive it or at last within 24 hours. In this case you keep the packaging as evidence. Otherwise we can not guarantee compensation. If we take the damaged or non-conform product back, you must return this merchandise within 15 days after the date of our confirmation.

5 Provided Articles

The provided articles are always defined in the description of the article in question.

6 Applicable Duty and court of jurisdiction

The present general conditions of sale are subjected to the Luxembourg right. All the litigations relating to the trade existing between the Purchaser and the Salesman are subjected to the exclusive of the Luxembourg jurisdictions.

7 Various

If one or more definitions of our conditions are ineffective, that is not valid for the other definitions. If we haven’t reached a different agreement, the payments in conformity with the law are in force.

Conditions of expedition and of transport

After the deal you will receive an email with all the details of your order. This can take about 24h. Please take note that Saturday and Sunday the time of 24h can be exceeded.
